We want to help spread the word about the amazing work across and around Cumbria To highlight this and showcase results and effort of yourself and others and their experience connecting with Cumbriamovement good course work. it’s good practice to inform parents that photographs and/or videos of their child may be used if the child has given consent

 

We want to make sure that you understand what you are allowing us to use and to share and therefore would like to formally gain your consent in this form too.

 

Please read through this form carefully to make sure you understand what you are consenting to. If you have any queries, please do not hesitate to contact us: cumbriamovement@gmail.com

 

Please note that this form can be used if you are the parent or guardian of either someone under the age of 13, or a vulnerable person and are granting consent on their behalf. Only for non completing aspects of the tour. 

 

WARNING: IN-LINE SKATING, SKATEBOARDING, SCOOTERING, PARKOUR AND BMX AND BICYCLING ARE DANGEROUS ACTIVITIES. BY ENGAGING IN THESE ACTIVITIES, THE PARTICIPANT ASSUMES THE RISK OF SERIOUS INJURY OR DEATH. THIS IS A RELEASE OF LIABILITY—YOU MUST READ AND FULLY UNDERSTAND THIS BEFORE SIGNING. IF YOU ARE UNDER 16, YOUR PARENT OR LEGAL GUARDIAN MUST SIGN THIS WAIVER.

 

Participation Statement: “Skatepark activities have a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions and involvement.” “When I attend this event, I enter an area where photography, audio, and video recording occurs. By entering I consent to such recording media and its release, publication, exhibition or reproduction.”

 

Additionally, appropriate safety protection is strongly advised to be worn at all times such as Helmet, Elbow Pads, Wrist Guards, Gloves and Knee Pads. If you are taking part in the competitions you must be older than 18 years of age.

 

Please do not smoke or drink alcohol or any illegal activities at this fertility.


 

What are you consenting to? 

This form allows Cumbriamovment to use image(s), film(s) and/or sound(s) that you have created and specified in the table(s) below (‘Content’) for Our Work. 

 

By completing and signing this consent form you give Cumbriamovement permission to: 

1. record, use, copy, store and publish the Content. 

2. share the Content with selected partners and third parties we work with (for example future organisations may be university of Cumbria, project 1, national lottery distributors such as Heritage Lottery Fund, government departments such as the Department for Digital, Culture, Media and Sport (DCMS), urban extreme and organisations hired by us to provide services such as external evaluators and auditors and) for the sole purpose of promoting Cumbriamovement good causes work.

3. Use  of  video for training, analysis, or for display purposes.

4. store copies of the Content for as long as is necessary to fulfil the purpose of promoting Our Work or to store your contact details on our database in case we need to contact you. 

 

Where might it appear? 

We use a range of ways to publicise the good work of Cumbriamovement good courses in many way and many aspects and therefore the Content might appear in our materials or the materials of third parties (please see above). It may appear in one of the following ways:

 • printed publications (including reports, leaflets and training materials) 

• marketing campaigns (including press coverage in newspapers, websites and magazines and branded publicity materials such as posters and banners) 

• online platforms such as our website and social media channels, digital slideshows and presentations, newsletters and internal communications systems

 • videos, podcasts and other digital materials


 

Your rights and responsibilities:

 You are the data controller of the personal information included in the Content (including that of the individuals participating in the Content (‘Participant’) and by signing this form you are agreeing that Cumbriamovement can process this personal information as we have set out in this form. We will comply with your written instructions about the use of this personal information.

 

 You are also confirming that you have the informed consent of the Participants to share the Content with Cumbriamovement and other third parties as set out in this form. 

 

Please note that if the Content contains someone under the age of 13 or a vulnerable person, you must obtain permission from a parent, legal guardian or authorised legal representative for their participation and the right to share their Content with us and other third parties as set out in this form.

 

 You have the right to withdraw your consent or any other information or data provided by you to us (including the consent of a Participant) at any time by emailing us at: cumbriamovement@gmail.com

 

Copyright and publicity By signing this consent form you are also agreeing to the following terms and conditions: 

 

• Payment: You agree that you will not receive or request any form of payment or royalty from us for the Content that either you or a Participant feature in. 

 

• Publicity: Should you be contacted by press or media, you agree you will obtain our prior written consent to appear in any form of media outlet (e.g. newspaper or magazine, television programme or radio), or in any other publicity purporting and social media to represent Cumbriamovement and Cumbria, or to speaking on behalf of Cumbriamovement and or in relation to a project of Cumbriamovement. You do not need to obtain our consent if you are speaking only about your own experience with Cumbriamovement.. 

 

• Intellectual property rights: You agree that you own the intellectual property rights to the Content and have the right to give permission to Cumbriamovement to use the Content as set out in this form. We agree that the photographer, artist or other current owner will retain copyright of the Content and agree to credit your Content.

I wish to take part in the event with cumbriamovement. I verify that I have full knowledge of the rigours and risk involved in skating and competing and that skating can be a dangerous sport. I am voluntarily using the urban obstacles or environment with knowledge of the dangers involved, including without limitation, the risks of disability, injury, loss, damages, or the negligence or deliberate act of another person and I agree to accept any and all aforementioned risks. I understand that by entering into the premises of the skating areas, I will be entering an area where many hazards exist, and I am aware of and appreciate the risks which may result from my use of those facilities. I understand that skateboarding,bmx scooter and other extreme sports under the influence of alcohol at these premises is prohibited. I am aware that accidents or illness can occur during skatepark events and that I may be seriously injured as a result. I acknowledge that I am solely responsible for my personal health and safety, and the personal property I bring with me. I agree to respect each other and rules that may be in place, to respect other riders, and to follow the organisation’s recommendations for my safety while attending the event. I understand that not respecting these rules could cause my exclusion from the event, through a decision of the OPERATOR. In consideration for being permitted to skating in the Skate Park, I agree to assume all risks and to release in advance and hold harmless and discharge the COMPANY, the OPERATOR, all affiliated organisations, individuals and entities, first-aid volunteers, officials, participating communities, organisations, and all of their respective parents, subsidiaries, officers, directors, agents, employees and members from any liability and to waive my rights with respect to any and all claims for damages personal injury or property damage which I may have, or which may hereafter accrue to me as a result of my usage of the Skate Park or jam, even though this liability may arise through no fault of my own, or from the negligence or carelessness on the part of the persons or entities being released, from dangerous or defective property or equipment owned, maintained or controlled by them or because of their possible liability without fault. I understand that my name, photograph, voice or likeness may be used by the COMPANY for promotional and advertising purposes, directly and through third parties, including the featuring of all of the foregoing in promotional materials and the assignment of all the exploitation rights to third parties, partners of the COMPANY, and this without any right to compensation and without time limitation. In particular, the rights hereby assigned to the COMPANY will include all the utilisation and exploitation rights worldwide and have to be considered unlimited with reference to duration, content, territory and transmission device. I consent to and authorise, in advance, such use and waive any rights of privacy and/or publicity I may have in connection therewith. I understand that, by entering and using the Skate Park competition and Cumbriamovement Jams, I consent that the personal information I submit with my entry being entered into a database and the COMPANY together with the OPERATOR may use this information for the purposes of the Skate Parks community culture, Cumbriamovement development . In addition, with my specific consent which is optional, the COMPANY may also collect my personal data for statistical purposes as well as for marketing purposes, notably to send me periodic communications containing information on the COMPANY’s products and/or services, as well as on its promotional or marketing initiatives, including possible invitations to said initiatives, it being understood that I can always oppose receiving marketing communications: every communication will contain a special section indicating the methods for withdrawing my consent. I understand that all my personal details will be stored at the office of the OPERATOR. A request to access, update, correct or delete any information should be directed to and provided address of the operative offices of the OPERATOR. Personal data is processed by the COMPANY and the OPERATOR in compliance with the security provisions as set forth by applicable laws and regulations in order to prevent loss of data, unlawful or unfair use of data and unauthorised access to data. I HAVE CAREFULLY READ THIS WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND ITS CONTENTS.

We do not take responsibility of rights and credit to all of the content and imagery, please be aware there will be multiple uses of photography and media present
